Purpose E-commerce companies use dark patterns to manipulate customer decisions to survive in the crowded online market and make profit. Although some online customers are aware of the dark patterns, they cannot overcome such manipulations. Therefore, the purpose of this study is to identify and model the barriers to overcoming dark patterns using total interpretive structural modeling (TISM). Design/methodology/approach Barriers to overcoming dark patterns were identified from the extant literature and were validated by a panel of 18 domain experts. In (...) the modeling phase, TISM technique was used to identify the relationships between the barriers and assign priority to the barriers. Finally, the barriers were plotted and classified into three categories. Findings User unawareness, trust in brands and normalization of aggressive marketing were found to be the highest priority barriers. Whereas, designer bias, user fatigue, short-term user benefits and design complexity were identified as the most challenging barriers because they have least dependence over the other barriers. Research limitations/implications Because TISM results are based on the opinion of domain experts, other statistical techniques could be applied for validation. Practical implications This study would educate online customers, while assisting online user communities and regulatory bodies to devise strategies to overcome dark patterns. Additionally, business managers could use the study’s findings to encourage designers to embrace ethical design methods as a competitive advantage. Despite the moral gravity and far-reaching consequences of ethical judgment, evidence shows that such judgment is surprisingly malleable, prone to bias, informed by intuition and implicit associations, and swayed by mere circumstance. In this vein, this research examines how mere colors featured in logos can bias consumers’ ethical judgments about a retailer. Exposure to a logo featuring an eco-friendly color makes an ethically ambiguous practice seem more ethical; however, exposure to a logo featuring a non-eco-friendly color makes the same practice (...) seem less ethical. This effect is due to the embodied meaning of color, not referential meanings associated with the names of colors, and it is mediated by perceptions of a retailer’s eco-friendliness. Furthermore, although the word “green” appears to influence ethical ratings of retail practices more than the word “blue,” visual exposure to either color evokes similar perceptions of eco-friendliness and influences ethical judgments. Study 2c assesses and rules out alternative explanations for this effect. Critically, an eco-friendly color can skew judgments even when the practices judged are not ethically ambiguous. Individual differences in ethical sensitivity moderate the observed effect, such that individuals who are less ethically sensitive are less influenced by color. The article concludes with a discussion on how logo colors shape consumers’ perceptions of retailer ethicality. (shrink)

Our concern in this paper lies with a common argument from racial discrimination to realism about races: some people are discriminated against for being members of a particular race (i.e., racial discrimination exists), so some people must be members of that race (i.e., races exist). Error theorists have long responded that we can explain racial discrimination in terms of racial attitudes alone, so we need not explain it in terms of race itself. But to date there has been little detailed (...) discussion of whether it is better to explain racial discrimination in terms of race or in terms of racial attitudes alone. Our goal is to offer a novel and detailed argument in defense of explaining racial discrimination in terms of racial attitudes alone, by attending to the neglected phenomenon of misperception discrimination, which involves differential treatment due to misperceived race. We argue that the discriminatory action in misperception cases must be explained in the same way as cases where (according to the realist) the victim’s race is accurately perceived. Thus, the victim’s actual race cannot provide the best explanation. The main upshot of our argument is that explanatory arguments from racial discrimination to realism about race fail. (shrink)

: There is an inherent ambiguity in the notions of inner and outer in Merleau-Ponty's philosophy even as his ideas attempt to reject the duality of transcendence and immanence. In particular, his philosophy of the body is inexplicably silent on the phenomenological experiences of the inner body. In contrast, the discourse and practice of yoga allow for a fresh phenomenological understanding of the inner body. Thus, it seems relevant to consider the wider implications of the practice of yoga to Merleau-Ponty's (...) thematization of the body and the world. The consequences of such a reflection are manifold and suggest that the "inside" can be understood as the phenomenological experience of dimensionality; the yogic practices of body postures and breathing techniques allow or a "perception" of the inner body, which then leads us to understand this perception in terms of the reversibility of consuming and consumed. The approach of looking at organizations from the perspective of Management Strategy, Structure, Systems and Style has been considered to be one of the useful ways for understanding and managing them well. In schools, the educational intent or educational philosophy or vision, which may be likened to the term strategy used in other contexts, is one of the determinants of the organizational structure, systems and style. The way these four elements interact with each other and manifest in the various processes (...) and functions of the school does influence the ambience and culture of school significantly. Management style appears to have the potential of actualizing the educational intent of the school by enabling the required scope for growth of teachers and students. The style also has a bearing on the extent to which the scope for growth brought about will be ‘utilized’ or realized by the teachers and students to actually learn and grow. The scope for growth and the growth experienced by students and teachers were studied and the correlation coefficient between the two tentatively determined. (shrink)

In a day in which there are different religious system vying for acceptance and probably even dominance, it is high time to identify a peaceful model for inter-religious understanding and communication. St. Paul had several interactions with the Jewish leaders, monarchs and government officials on religious topics and issues in between A.D. 60 to A.D 62 at Caesarea. His interaction with King Agrippa II and Governor Festus can be used as a paradigm for contemporary inter-religious understanding and communication. Even though (...) Paul’s life was hanging on a balance as a prisoner about to be transported to Rome, he did not resort to violence, verbal abuse or rain down curses, when his religious claims were questioned. Instead, he argued as a seasoned philosopher, prayed as a pious saint and appealed as a prisoner in chains with humility for the ‘veracity and the reasonability’ of his truth claim. The article will interact with few philosophical themes that surface during this discourse and dialogue and also attempt to trace St Paul’s use of rhetoric in his discourse. The title of this article is ‘St. Paul’s discourse and dialogue with King Agrippa and Governor Festus as a model for contemporary inter-religious understanding and communication’. The primary source for this article is the book of Acts in the New Testament and the secondary source would be dictionaries and books. (shrink)

Morality is an abstract consideration, and language is an important regulator of abstract thought. In instances of moral ambiguity, individuals may pay particular attention to matters of interactional justice. Politeness in language has been linked to greater perceptions of social distance, which we contend is instrumental in regulating attitudes toward a brand. We posit that politeness in a brand’s advertising will impact consumers who are attuned to violations of interactional justice [i.e., those with low belief in a just world ]. (...) In three studies, we demonstrate that the politeness used in advertising as well as consumers’ individual differences in BJW affect judgments and attitudes toward brands. Specifically, individuals with a low just world belief are more likely to harbor negative attitudes towards a brand with ethically ambiguous business practices if the language used in advertising is impersonal than when the language used in advertising is personal. Importantly, for individuals with a low BJW, lowered trust due to the advertisement’s language mediated the relationship between politeness and attitudes toward the brand. Bhakti is a remarkable existential tendency that shows itself in the rich expanse of the tradition originating from the Vedas. Recognized as a prize possession of the religions, philosophies, and culture of India, it has often won fascination and admiration from students of Eastern heritage. However, its nature, role, and history remain misunderstood and have not received all the attention they deserve. Its role as a gatherer of life, love, thought, and the divine is missed in its partial characterizations as (...) “Hindu devotion” or “divine love” or “theism implicit in polytheism.” Its status as a perennial thematic concept of the Indian civilization is missed when its pervasiveness is overlooked by the cultural historians preoccupied primarily with its periodic eruptions. Furthermore, the philosophical role of bhakti is missed when it is deemed as an alternative to jnana (knowledge) rather than “the living of jnana.”. (shrink)

Published, as it was, before our fascination with things New Agey, it dispels many of the myths and misconceptions that have arisen and been promoted out of that movement. And for this reason alone, for the preservation of the truth, it is worth its weight in gold. First and foremost among the myths it dispels is the idea that developing concentration is (...) really of no consequence in the practical application of the art of meditation, as some so-called New Age gurus would have people believe. This is like saying that for an automobile to function properly it doesnt need gasoline! Drawing on JRD Tata's philosophy and approach to business, it shows how business and philanthropy were intrinsically related for him. JRD Tata was arguably one of the most influential businessmen in post-independence India. It is often remarked that Indian logic (IL) has no conception of necessity. But what kind of necessity is absent in this system? Logical necessity is presumably absent: the structure of the logical argument in IL is often given as a reason for this claim. However even a cursory understanding of IL illustrates an abiding attempt to formulate the idea of necessity. In Dharmakīrti's classification of inferences, one can detect the formal process of entailment in the inferences arising from class (...) inclusion. In Western philosophy, Leibniz's invocation of 'contingent necessity' as distinguished from the 'necessary necessity' is part of a tradition that finds value in the idea of contingent necessity. In contemporary philosophy, this has been championed by Armstrong, specifically in the context of understanding the necessity inherent in scientific laws. In IL, the analysis of 'invariable concomitance' (vyāpti) is of crucial importance and its definitions are very complex. This paper argues how vyāpti can be understood in terms of contingent necessity and also how the complex definitions can be interpreted as an attempt to define contingent necessity in terms of 'logical' necessity. When I first encountered Indian philosophy after having studied Western philosophy, two examples of comparative interest caught my attention. One was Saussure's theory of meaning through difference (which led to the vibrant traditions of structuralism, poststructuralism, and postmodernism). I was immediately struck by the stark similarity between this theory and the Buddhist apoha theory of meaning. The other example was that of Hume, and in this case I was amazed at the sophistication of the Indian philosophical discussions on the problem (...) of induction compared to which Hume's analysis was quite pedestrian. A critical interpretation of Sikh literature from a feminist perspective.

This paper compares the findings of content analyses of the corporate codes of ethics of Canada's largest corporations in 1992 and 2003. For both years, a modified version of a technique used in several other studies was used to determine and categorize the contents of the codes. It was found, inter alia, that, in 2003, as in 1992, more of the codes were concerned with conduct against the firm than with conduct on behalf of the firm. Among the changes from (...) 1992 to 2003 were a significant increase in the frequency of mention of environmental affairs, legal responsibility as the basis of codes and enforcement/compliance procedures. Violence risk assessment tools are increasingly used within criminal justice and forensic psychiatry, however there is little relevant, reliable and unbiased data regarding their predictive accuracy. We argue that such data are needed to (i) prevent excessive reliance on risk assessment scores, (ii) allow matching of different risk assessment tools to different contexts of application, (iii) protect against problematic forms of discrimination and stigmatisation, and (iv) ensure that contentious demographic variables are not prematurely removed from risk assessment tools.

This chapter explores how perspectives on science drawn from Indian experiences can contribute to the interface between history and philosophy of science (HPS) and science education (SE). HPS is encoded in science texts in the various presuppositions that underlie both the content and the way the content is presented. Thus, a deeper engagement with contemporary work in HPS will be of great significance to science teaching. By drawing on the notion of multicultural origins of science as well as redefining the (...) nature of science debate by invoking the Indian engagement with science, this chapter aims to make both HPS and SE more sensitive to other cultural understandings of science and scientific method. The last two sections describe ways of drawing on the Indian philosophical traditions that could be relevant for contemporary debates, such as constructivism and teaching critical thinking, in science education. Khemlani et al. (2018) mischaracterize logic in the course of seeking to show that mental model theory (MMT) can accommodate a form of inference (, let us label it) they find in a high percentage of their subjects. We reveal their mischaracterization and, in so doing, lay a landscape for future modeling by cognitive scientists who may wonder whether human reasoning is consistent with, or perhaps even capturable by, reasoning in a logic or family thereof. Along the way, we note (...) that the properties touted by Khemlani et al. as innovative aspects of MMT‐based modeling (e.g., nonmonotonicity) have for decades been, in logic, acknowledged and rigorously specified by families of (implemented) logics. Khemlani et al. (2018) further declare that is “invalid in any modal logic.” We demonstrate this to be false by our introduction (Appendix A) of a new propositional modal logic (within a family of such logics) in which is provably valid, and by the implementation of this logic. A second appendix, B, partially answers the two‐part question, “What is a formal logic, and what is it for one to capture empirical phenomena?”. (shrink)

The aim of this article is to return to the concept of bricolage as theorized in 1962 by the French anthropologist Claude Lévi-Strauss and examine its presence and utility in the art and architectural history of the twentieth century. While Lévi-Strauss was the first theorist to present bricolage as an analogy for the creation of mythical thought among indigenous cultures, the concept has seen a wide range of conceptual, methodological and practical applications across different fields, including design, visual arts, urban (...) planning and the built environment. This article will examine the applicability of bricolage as a technical metaphor for the creative process and its relevance to artistic creation by tracing its trajectory over the course of the twentieth century. It will evaluate the significance of objects and events of ‘everyday life’ in the creative practices of contemporary artists, and draw attention to the emerging role of the architect as bricoleur or improviser, to conclude that it was the art of the ‘ordinary’ that gave creative inspiration to twentieth-century artists and architects to engage with the materiality and past experiences of the world. Buddhists endorse the concept of human actions and their consequences as they uphold the doctrine of karma. However, they deny the existence of a ‘permanent self’. Few questions arise in this regard. If a permanent self does not exist then who guides a person to decide the course of an action? How does a person choose to perform an action of the many alternatives in a situation? Who takes responsibility for the consequences of an action? This paper attempts to answer (...) these questions by reinterpreting the Buddhist’s ‘no-self’ theory from epistemological and logical perspectives. This paper argues that Buddhists while rejecting the existence of a ‘permanent self’ affirm the existence of impermanent psychophysical entities (five skandhas). The mereological sum of these psychophysical entities is known as a ‘person’ who performs actions. A person becomes morally responsible for the consequences of an action justifying the Buddhist doctrine of karma. (shrink)

The uniqueness of Psychiatry as a medical speciality lies in the fact that aside from tackling what it considers as illnesses, it has perchance to comment on and tackle many issues of social relevance as well. Whether this is advisable or not is another matter; but such a process is inevitable due to the inherent nature of the branch and the problems it deals with. Moreover this is at the root of the polarization of psychiatry into opposing psychosocial and biological (...) schools. This gets reflected in their visualization of scope, in definitions and in methodology as well. Whilst healthy criticism of one against the other school is necessary, there should be caution against hasty application of one's frame of reference to an approach that does not intend to follow, or conform to, one's methodology. This should be done within the referential framework of the school critically evaluated, with due consideration for its methods and concepts. Similarly, as at present, there is no evidence to prove one or the other of these approaches as better, aside from personal choice. We can say so even if there is a strong paradigm shift towards the biological at present. A renaissance of scientific psychoanalysis coupled with a perceptive neurobiology which can translate those insights into testable hypotheses holds the greatest promise for psychiatry in the future. This suggests the need for unification of diverse appearing approaches to get a more comprehensive and enlightened worldview. It requires a highly integrative capacity. Just as a physicist thinks simultaneously in terms of particles and waves, a psychiatrist must think of motives, emotions and desires in the same breath as neurobiology, genetics and psychopharmacology. However, the integration must be attempted without destroying the internal cohesiveness of the individual schools. This will give a fair chance for polarization in which a single proper approach in psychiatry could emerge, which may be a conglomerate of diverse appearing approaches of today, or one which supersedes the rest. A synthesis of cognitive psychology and neuroscience offers the greatest promise at present. (shrink)

This paper unravels the diverse strands in the manifestations of the Prevention of Terrorism Act (POTA, 2002), focusing not only on law’s words, i.e. the rules, principles and procedures, and its interpretations in judgments, but also on its effects. Adopting the violence of jurisprudence approach, it eschews the dichotomy between law and violence, examining the ‘effects of legal force’, in particular, the ways in which law becomes an integral part of the organization of state violence. Through an examination of the (...) unfolding of POTA and laws dealing with ‘organized crime’ and ‘unlawful activities’ (Unlawful Activities Prevention Act, 1967, 2005), the trajectory of specific cases and judgments by Trial Courts, the High Courts and the Supreme Court, this paper shows how through an interlocking of the ordinary and extraordinary, anti-terror laws erode both the procedural and substantive aspects of the rule of law, become the terrain where permutations in alliance politics and configuration of power are played out, and assume an antagonistic notion of politics which seeks resolution through the elimination and externalization of difference. Extraordinary laws, it argues, are manifestations of a politics of negation. Processes that prolong the lives of such laws, and procedural interlocking and intermeshing that seek to give them permanence, are symptomatic of a deepening of the politics of negation. (shrink)

Early intervention aims to identify children or families at risk of poor health, and take preventative measures at an early stage, when intervention is more likely to succeed. EI is concerned with the just distribution of “life chances,” so that all children are given fair opportunity to realize their potential and lead a good life; EI policy design, therefore, invokes ethical questions about the balance of responsibilities between the state, society, and individuals in addressing inequalities. We analyze a corpus of (...) EI policy guidance to investigate explicit and implicit ethical arguments about who should be held morally responsible for safeguarding child health and well-being. We examine the implications of these claims and explore what it would mean to put the proposed policies into practice. We conclude with some remarks about the useful role that philosophical analysis can play in EI policy development. (shrink)
